Terms and conditions

This section of the Nexplanon.co.uk website (the "Site") has been designed to enable women to subscribe to receive a reminder by e-mail about the removal of the contraceptive implant Nexplanon (the "Reminder Service").

This service is an aid to a reminder and should not be relied upon to be the only reminder. The user of the Nexplanon contraceptive implant is responsible for remembering to book an appointment for the removal of the contraceptive implant according to the instructions given to them by their healthcare professional and directions for use in the Summary of Product Characteristics. The providers of this service shall not be liable for any consequences of late or non-delivery of messages, for any reason.

Use of the Reminder Service

The Reminder Service is administered and operated by Anytime After Nine Ltd ("AA9") from its offices in the U.K., on behalf of Organon Ltd ("Organon"), (together, the "Service Providers"). By subscribing to the Reminder Service, you accept, without limitation or qualification, these Terms and Conditions. If, either now or in the future, you find these Terms and Conditions to be unacceptable, you must immediately terminate your use of the Reminder Service. The Service Providers reserve the right to change these Terms and Conditions from time to time without prior notice, as they deem necessary. You are advised to check them regularly.

Registration and Privacy

You agree to provide such information about you as prompted by the user subscription page and you further agree to ensure that such information shall at all times be true, current, accurate and complete.

The Service Providers respect the privacy of users of the Reminder Service, and users should refer to the Privacy Policy for disclosures related to the collection and use of your personal information.

Message delivery

While every effort is made to deliver e-mail messages in a timely fashion, time for delivery of such messages will not be of the essence and the Service Providers shall not be liable for any consequences of late or non delivery of messages, for any reason.

Termination

Without prejudice to any other rights or remedies the Service Providers may have, if you engage in activities, whether lawful or unlawful, that either of the Service Providers determine in its sole discretion to be harmful to its operations, reputation, goodwill, or customer relations, the Service Providers may immediately terminate your subscription to the Reminder Service without notice.

Disclaimer

AA9 processes messages on an automated basis and, save for admin messages generated by AA9, is not responsible for the contents or the accuracy of any message; or for the views or opinions contained therein. Examples of admin messages generated by AA9 include password confirmation e-mails, validation code transmissions to e-mails etc.

You agree that use of the Reminder Service is at your own risk. The Service Providers make no warranty that the Reminder Service will be provided to you to any particular standard and hereby expressly exclude, to the fullest extent permitted by law, all conditions, warranties and other terms that might otherwise be implied by statute, common law or the law of equity. In particular, and without limitation, the Service Providers do not represent or warrant that:

the Reminder Service will meet your requirements;
the Reminder Service will be uninterrupted, timely, secure, or error-free; or
using the Reminder Service and any results obtained from using the Reminder Service will be to your satisfaction.

Limitation of Liability

The Service Providers hereby expressly exclude any and all liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Reminder Service including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to either of the Service Providers. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise.

Nothing in these Terms and Conditions shall exclude or limit the liability of the Service Providers for death or personal injury resulting from the negligence of the Service Providers or for fraudulent misrepresentation. If you are a consumer, your statutory rights, if any, are not affected.

Governing Laws

English law governs these Terms and Conditions and their interpretation, and the English courts shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms and Conditions.

Miscellaneous

If any provision of these Terms and Conditions is held to be unlawful, void or unenforceable, then such provision shall be severable without affecting the validity, legality or enforceability of all remaining provisions. Except as expressly provided, these Terms and Conditions constitute the entire agreement between you and the Service Providers with respect to the use of the Reminder Service.
